COMPLAINT UNDER SECTION 12 OF THE CONSUMER PROTECTION ACT, 1986
MOST RESPECTFULLY SHOWETH:
1. That the complainant purchased sam sung fridge worth 35000/-rs from Shiv light house 1/ab Krishna Nagar Mathura – 281004 uttar Pradesh.
2. The details of sam sung fridge were RT37143359 and purchased on 13/04/2022. Wth invoice number GSTKN/0456 AND attached invoice copy. Since purchase there are frequent troubles in fridge and there is breakdown main pcb of fridge on 08/02/23. The service personal came and replaced the pcb and again on 03/05/23 again the main pcb broke down. The service personal telling out of warranty.
3. Any one purchase fridge with mental peace that will at least 5 years with out any trouble. I have another REFRIGERATOR in my home which is working sice 25 years without any trouble or service. But this Samsung not worked satisfactorily with in year. Service personal asking 3600 forpart and 700 for service . total of 4200/rs. This will be cycle.
4. The shiv enterprise supplied defective product to me so I am requesting you sir kindly refund the money as it is defective product. The product mentioned 10 years warrenty.
5. The fridge is giving considerable mental agony to me. In this regard I have served legal notice both Samsung india electronic pvt limited and shiv brothers Mathura ON 26/05/23. And acknowledgement of speed post attached with complaint. And I have received any solution from them.
6. The Samsung india electronic pvt limted responed to my mails and telling that they are looking in the matter and have patientce but unable to provide any solution.
7. With this complaints I am attaching all documents
8. The notice is delivered to Samsung india electronic limited and shiv brothers by registered post and 08/06/23 and no response from both parties
9. The opposite party is not responding as they giving lot mental agony and there fore liable to compensate the fridge.
8. That the cause of action arose on 03/05/23. As the refrigerator is defective
9. That for the purposes of section 11 of the Act, compensation claimed by the complainant is below Rs. 1,00,000/- Rs (One Lakh rupees) so this forum has jurisdiction to determine and adjudicate this dispute.
10. That the complainant is a consumer as defined under the act.
PRAYER:
In the above mentioned facts and circumstances it is most respectfully prayed that the Hon’’ble Forum may be pleased to:
a. Order the opposite party to pay Rs.50,000-Rs as compensation and costs of suite
b. Pass any other such order, as this Hon’’ble Forum may deem fit and proper in the interests of justice.
