I am an NRI working abroad in Middle East. One of builder in my city show me land and told me that he has all rights of this land to build a shopping complex over there. He also showed me brochure in which it is mentioned that map for construction complex is approved by District Development Authority and the construction onsite will be started soon. Therefore I booked 3 shops in that complex worth Rs 34 lakh. We both parties prepare agreement in the notary/court stating that builder has the authority for making shops over that land and within 1 year he will construct the shops and I have to make 10 lakh advance and rest of the 24 lakh after construction and all the shops . As per agreement I made a payment of 10 lakh through cheque. Now already 2 years finished but he didn’t start the construction. Recently I came to now that he doesn’t have any legal rights to construct that building over that land. Moreover also he didn’t have any District development authority approval and all is fake. Now I am asking my money back but he is not returning it and making excuses and false promise every day. It seems that he had no intention to give my money back and just passing the time. Since I am working abroad and can’t chase him on daily basis therefore he is taking advantage of that.
