Regarding Recovery of the excess payment of Rs. 85,980.00, made by me to Mahagun Real Estate Pvt. Lt

I am a buyer of a flat in Mahagunpuram at NH-24 Mehrauli Gaziabad U.P. I booked the Unit No. 274 Godavari in the Mahagunpuram NH-24 Mehrauli Gaziabad U.P., way back in June 2015 with a promise of delivery of the flat in December 2015 . Though the offer of possession not been made by till date. It’s really been a torture for so many years as I am paying the EMI for the Home loan for the same period. This whole time I kept running from pillar to post and at last decided to opt for the FIT OUT option and paid all the dues, as asked by Mahagun's representative. After so much of efforts and agony Finally I was handed over the flat (only FIT OUT) on January the 7th this year after making all the dues along with the excess payment of amount Rs. 85,980.00. It happened because of the cheque of Rs. 3,50,000.00, made for Mahagun Real Estate Pvt. Ltd was more than the amount to be paid to you at the time of making the payment (Rs. 2,64,020.00).

On January the 22nd 2019, Mahagun's representative at its corporate office at the Corenthum Building, Sector 62, NOIDA, accepted the same cheque making a promise the refunding the excess payment of Rs. 85,980.00 at the earliest, immediately after “Certain Formalities”are over.

Sir/Madam now it’s been more than four months I paid the full dues along with the excess payment of Rs. 85,980.00, and been asking Mr. Manish Mahagun's representative at Mahagun's corporate office at the Corenthum Building, Sector 62, NOIDA for this issue but till date no satisfactory reply is being given by him. I am being tortured for the giving the more amount than the required from my side. I am being run from pillar to post for no fault of mine. Here I am paying the interest of the amount and Mahagun is keeping that amount Mahagun has no right over.

Later on I was asked to contact onesenior person Named Mr. Arvind and get the things sort out. but after making some mor false promises he also stopped to receive my calls.Then I contacted Mr. Amit, again a senior one. He also looked into the matter and promised to sort out this issue but still no positive reply. They are alo not giving anything in writing.

I request you to look into this matter and sort it out by refunding the excess payment of Rs. 85,980.00 at the earliest.
