Makemytrip is not refunding the amount for cancelled flight

Hi,
My name is MOHIT, I booked my fight from to and fro journey for BANGALORE-JAIPUR travel. I booked it via makemytrip mobile application and choose air costa flight for this trip.

But unfortunately AIR-COSTA stopped working for some operational issue and makemytrip asked me to completely new and different booking and for previous booking where flight AIR-COSTA flight stopped working they told me that 100% refund will come back. Then when I approached makemytrip for my 100% refund (since it was not a cancellation from my end , it was cancellation from airlines itself.) then makemytrip people say that we will not refund the amount until they get money from AIR-COSTA airlines. On the other side I tried reaching air-costa where those people and their customer care number everything is in non-responding mode.

I doubt that makemytrip is really serious about getting my money back from air-costa or not. So now even after not getting refund amount from makemytrip after 4 months also, finally I want to take a legal action against makemytrip.

I approached them many times via their complain board system and via calls emails etc , but there is no result or conclusion. It has taken my lot of time , money and had given lot of metal pressure to talk to them again and again.


Please suggest me what may be the BEST CASE which I can file against makemytrip. Also please suggest me do I need to file case against air-costa airlines as well. For me it is makemytrip whom I paid via online transaction so they are the only responsible people to refund my money.

Along with legal consumer case , can I file a fraud and forgery case against makemytrip company and against AIR-COSTA both.

I booked my tickets for this trip on 15th Feb 2017 and then makemytrip people only cancelled flight on 12th Mar 2017.
From there to till today It is now almost 4 months of time , but there is no refund.

Note: Total money which I paid to makemytrip is 8831.00 INR but now I want to sue them for every problem that was caused due to their unresponsive behavior to the customer.
