Irresponsible acts of officials, client holds a savings account in Indian Overseas Bank

My client holds a savings account in Indian Overseas Bank, No.134-138, Main road, Kovilpatti – 628501, and her account number being 077801000016219. My client approached the Bank on 03.09.2016 bearing a cheque of State Bank of India, S.N. High road, Tirunelveli Junction cheque number being 204733 issued by the Government of Tamil Nadu for Honourable Principal District Court, Tirunelveli, with intend to deposit and encash the same through her savings account. On the very offset the bank officials have refused to entertain the cheque to be transacted through her savings account. After lot of persuasion on the side of my client the bank officials have accepted the cheque to be transacted through her savings account. To her surprise and astonishment she was informed of the fact that the cheque was dishonoured on 05.09.2016 with an endorsement that “Kindly contact drawer drawee bank and please present again”. The bank officials have also wantonly refused to entertain re-presentation of the said dishonoured cheque. When my client enquired about the reason for such dishonour the bank officials have absurdly uttered un-Parliamentary words against my client as well as The Honourable Principal District Court, Tirunelveli before the customers present within the four corners of the branch. The bank officials have gone to the extent of passing derogatory remarks that the reason for dishonour should be gone only with The Honourable Principal District Court, Tirunelveli and furthermore, they have thrashed the reputation of the Court to its core by saying that The Honourable Principal District Court, Tirunelveli might be bankrupt. The bank officials have further passed a highly condemnable remark to my client to challenge the said dishonour of cheque by way of filing complaint under Sections 138 & 142(b) of the Negotiable Instruments Act 1881 in a competent court against The Honourable Principal District Court, Tirunelveli. My client has been bounced from pillar to post for reasons best known to them. The act of negligently bouncing back the cheque clearly exposes the willful, wanton, default, negligent and deficiency in service on their part casting great mental agony and a huge monetary loss to my client which can’t be expressed in terms of money.


Kindly initiate disciplinary action against the erring officials at the earliest and intimate me about the improvements nor my client will be placed in a position to challenge the bank officials for their scandalous acts before competent Civil and Criminal Courts of law and they will alone be held liable for all the consequences arising thereof and they will be mulcted with costs.
