I am Bhavdeep who bought Flat No: J-505 at Amrapali Princely Estate., Secto 76, Noida, UP on 30/07/2010.
As per agreement flat to be completed in 30 to 36 months from signing the agreement.
I received final demand letter along with Possession intimation letter in February 2015 (though flat is not complete).
As per Possession Intimation letter the flat will be handed over with in 60 days of recceiving the full payment (check attachment). I have submitted NOC to flat handing over team on 03 April 2015 (copy attached). But till now I have not been handed over flat. I have paid more than 15 visits to Princeley at regular intervals, many phone calls and met DGM Mr. Rajiv Ranjan of handover team. Every time I received a false promise from him that it will be handed over next month or in 15 days.
Because of Amrapali Princely Estate not keeping her word of possession letter that it will be handed over in 60 days, I am paying EMI and house Rent of Rs 22000 per month plus maintenance of Rs.1500 per month. In addition to that trauma of going to meet the builder's team every 15 days and waiting for them for hours to get listen and then bearing with their lies and false promises.
As per final demand letter if I do not pay amount with in 10 days then interest will be charged as agreed in Flat Buyer agreement (which is 18% p.a. for first month and 24% p.a. then onwards) see attachment. Since I paid full amount by 03 April 2015, so I demand that you pay me the same interest rate on my entire amount for the delayed months that Amrapali Princely Estate were supposed to charge me as per flat buyer agreement.
Moreover as per penalty caluse Builder wis supposed to pay Rs. 10 per sq ft. penalty. I raised this issue in February 2016 with Ambuj and Aditi who sit at Amrapali corporate office, Sector 62, Noida and deals with Princely Estate. They have not given me any penalty which I desperately need as I have to pay both rent and EMI. See the attached received copy of asking for pay me penalty application.
I request you to help me getting compensation in terms of interest (same that you charge from buyer if delay) on full amount I paid. I should be compensated with penalty as per buyer agreement and for the mental trauma I face. I request you to help me in compensation and handing over of my flat.
