worst service by Ebay

Hi Sir,
My name is Ritesh P V. I opted for a new "100% Original Xiaomi Mi 10400mAh Power Bank with USB LED LAMP FREE " from Ebay. I paid the amount by cash on delivery. On the site it is mentioned 6 Month warranty for this product. Have not received any warranty card with the package nor did I receive USB LED LAMP Nor the product is new.
Few days later determined the product is a fake ( from MI service center). Feeling cheated by Ebay, as they have provided fake power bank and incomplete delivery product. In the product it is mentioned that I will have a free USB LED LAMP but not received it. Also have not warranty card received.
Funny thing I register the product from ebay got the product from ask me bazzar.com (box wrapped with ebay cover). Also the cable was not new, It had traces of mud that cannot be removed. The apperance of the power bank was different as shown in ebay site. This product has a warranty of 6 month ( Manufacture Warranty) but I don't see any warrant card in the box. All I see a invoice on the box.
I register for refund using the claim back policy as they have defined in their site.
No response from them ( only the initial refund claim response sent on 11-04-2016). Neither did I had the time to call them. So on 16-04-2016 I opted for the callback ( that they have provided in their site). They called after few minutes and asked what is the issue. I explained them the whole thing. They again arranged the callback I don't know why.
I waited again for few hours and then I received the call. Next representative (from Ebay) called me and She started to tell me that it is not Ebay issue. She got harsh and mentioned that I need to contact the Manufacturer ( service Center). I tried to explain her that I had register the complaint as " Item not as expected".
But she gave me the xiaomi service center number and ask to call them. She told me to get the written proof from the service center saying that this product has issues. I don't understand, why should I run with this used crap product to service center. I opted for a new product and I don't see a new one.
I was discussing with my friends and found that this product may be even fake. I just tried to verify by comparing the product with the xiaomi site ( http://en.miui.com/thread-19104-1-1.html) found this product given to me is a fake one.
Now I do realize why the powerbank was not sent with a warranty.
Now I had a reason to go to xiaomi service center to get this in writing. I went to the service center mentioned in the xiomi site ( www.xiaomi.com/.in/services/repair/) ----------> Bangalore HCL Services Limited,155,1st floor, 24th cross,19th main road,Rajajinagar 2nd Block,Bangalore- 560010, Navarang theatre next signal towards chord road , Phone: 080-41169172 .
The representative ( MI service center) expained that they can verify and let me know if this is genuine or not but they will not give anything in writing as this is against the policy of their company.I called the Ebay (1800 209 3229). After few minutes I told the ebay representative to talk to the service center guy. The service center representative clearly mentioned to the ebay representative that the product is fake.
But the Ebay representative was in denial. He didn't talk anything to service center guy. I told him if he can transfer the call to his superior. He said it is not required. He asked for few minutes as he want to discuss this with his backend team. He came back and again settled for a call back within 75 hours. I told him I cant keep on coming to service center. He mentioned that he will notify his senior who will be calling me that the service center is not giving the written statement.
I got the next call (24th april 4:50 PM) on my another no from Ebay (+912261322300). Again he said the same. He wants a written statement from service center. I asked why didn't he took the call when I was in service center. He was denial and said he is going to close the claim as it is no more Ebay issue.
Now overall I have got the fake xiaomi power bank, No warranty card and no USB LED LAMP. All I have got is a feeling of being cheated.
I don't know what to do next. I don't have the proof in writing and Ebay will not help me. I believe only consumer court can help me with this. Please help me !
