Mobile is not received after making payment

Dear Sir, I (Arvind Suryavanshi - 9818130052) have contacted directly to the Sellar "Dinesmeht_8" of www.ebay.in for purchase of Samsung Note 5 Dual SIM, 64GB since ebay website is not working. Sellar contact details is 9820597710. I have deposited Rs 38000/- to his account on 22/02/2016 . He promised me to deliver the phone on 23/02/16 but from 23/02/16 onwards his phone is switchoff. I am unable to trace him.
I have bank payment receipts, whatsapp communication etc. Please help me out
