Defective product and no refund

I bought the product (mobile phone) from ebay and the phone which i received is defective. I informed the company and they asked me to apply for claim so that i can get my money back. I did that on 19th of march. It had been almost a month but they are not doing the necessary work. No one is giving ay resolution. I had been calling the customer care every now and then. They keep on telling that they will give a call back but nothing is happening.
Please take a stern action against these guys. This is a case of online cheating.
