I booked the flat with Runwal My City Dombivli in 2015, since then I paid around 11 Lakhs including Stamp duty and registration (SDR). My flat was on 23rd floor, Runwal initially said that they will build 26 Floors and will give possession in Dec 2020, however later on they got approval only till 22nd floor from municipality and even pushed the date of possession in Dec 2022, when I approached them they gave me the option to take a flat on the lower floor or take a refund. When I initially booked, they said all the flats at lower levels are sold out and flats are available from 20th floor onwards, but now they are giving the option to book on lower floor.
They were giving refund only for amount paid by me to them and said SDR will be forfeited, I argued on email that why my SDR money should be forfeited if they never registered the flat on 23rd floor.
Finally they agreed to pay but from last 2 years they are just delaying the payment, I want to file a case not only for my refund but also for harassment they caused to me over the last 5 years.
