This is with regards to the fraud committed by Mr. Getamber Anand pertaining to refund of buyback amount under subvention scheme for a Tourmaline Apartment No. 4062, 6th floor, Tower 4th Sector, 109B, Gurgaon. As per the MoU, Buyer-Seller Agreement, tripartite agreement executed in March 2014, the concerned gentleman was supposed to buyback the subject unit i.e. 4062 on 6th floor in the 4th tower with a built up area of Rs. 2150 SF @Rs. 9500/SF after 36 months which was initially booked by myself at Rs. 7600/SF under the subvention scheme announced by the developer. The flat was booked, and payments were effected as per schedule after taking the loan from ICICI bank amounting to Rs. 1,34,20,000 by me (P. Balendran) at a floating interest rate of 10%. As per the agreements reached the buyback differential amount of Rs. 40,85,000, should have been refunded to me by March 2017 but at the same time, on surrender of documents for the buyback proceedings, Mr. Anand's office had sought a meeting with all of the buyers including myself, and requested extension of time till July 2017 to refund the amount. We have exchanged a number of messages for the refund in the intervening period, and upon request by the developer because of financial constraints at his end, I did give him some more time. However, today we are in 2022, and since the subvention scheme got over in 2017, the bank has started to claim interest on me. On being approached for the interest burden falling on me because of lapse on the developer's part, he had agreed to pay the full amount (interest + principal) to settle the O/S dues. Now this commitment has obviously not been honored even 4-5 years after we raised a request. Rest of the details in the notice as attached.
