Within warranty period battery not avilable, purchased INTEX AQUA VIEW from Virati Communication

I had purchased INTEX AQUA VIEW mobile in 8/2016 from Virati Communication ,Indira Ngr, Nashik 9 (As it was made in INDIA).
From May 2017 I am facing problems with battery. After searching at many places finally I placed an order on 21/6/2017 at INTEX service center Nashik and paid Rs. 400 /- as an advance. They assured me that the battery will be available in 8-10 days. But even today the battery is not available with them. Every time they are giving me false commitment . In this month the warranty of my mobile unit will end in such case what shall I do? Technically the unit should be replaced with in warranty. Please guide me in this matter. I want finish this matter before warranty ends.
