Iphone purchase from Ebay is damaged and battery not working

I have purchase an Iphone5 from ebay.(Item no-182110428046, Regsitered email id-rohit300587@gmail.com)

First of all the order i recieved after lot of followups.

2ndly the battery of my phone is not working for mre than 2 hrs & it keep searching for signal everytime. the phone is good for nothing. I am not able to make calls, messages. It was mentioned as a new phone but i doubt.

I called up lot of times to ebay customer care. they always give excuse that we will get a call within 72 hrs . but no use

I am fed up of making n no. of calls. It is a complete wastage of my time & money.
