Dear Madame,
this is Prof. Hari Shankar Mahato from IIT Kharagpur. My wife Mrs. Amrita Shankar Mahato wanted to buy a bunk bed for our son. She found the offer from one lady from Bengaluru on Quikr.com. Her name is Mrs. Thushitha Kruthi Velampati. Initially my wife found her offer within our budget so she contacted her. My wife asked her many times via chat (both on Quikr and Whatsapp) that whether the bed is in good condition or not? Whether it is broken or not? Every time Mrs. Thushitha Kruti Velampati said that the bed is in “good condition and no damages whatsoever”. We have a whole chat history with us which can prove this point.
Now buying Mrs. Thushitha’s argument my wife believed her and decided to buy the bunk bed. Finally, the payment has to be discussed. The final price was discussed to be Rs. 12000 including shipping. Since we are in Kharagpur and Mrs. Thushitha is in Bengaluru, we did not want to transfer the whole money, so we were in dilemma. It was then Mrs. Thushitha proposed that we’ll transfer the first Rs. 6000 and then she will dismantle and pack the bed for the shipment. And after she ships it, we’ll transfer the next Rs. 3000 to her account and finally when we receive it we’ll transfer the remaining Rs. 3000. Having no other options and overshadowed with the lies of Mrs. Thushitha, my wife accepted the offer. I transferred the first Rs. 9000 to Mrs. Thushitha’s account using BHIM UPI payment platform. We received the item on July 19th at 5:30 PM at our residence in Kharagpur. Obviously my wife was excited because it was a gift from her to my son on his birthday. Before making the final payment, we wanted to check the condition of the bed so around 7:30 PM I opened 3 packages out of 11. It was then the whole disappointment started.
It is a used bed which was fine with us but it should have been in usable condition. That is the reason my wife kept asking what is the condition of the bed and how it looks, and Mrs. Thushitha always replied “in good condition and no damages”. However, the bed which we received is in completely trashy condition. Almost all the parts have fungus all over, oil marks, coating paper coming out, the woods pieces are broken to bits at the corner, the sockets are coming off, the wood is loosing its integrity and cracks are seen everywhere, the stairs leading to the bunk bed is broken and several others traumatic images. I immediately contacted Mrs. Thushitha, it was then she totally flipped from her statement and started giving arguments like it was used bed and bound to be broken and all. She started refraining from her arguments and started giving me excuses of all sorts. She didn’t accept any liability at all. She started accusing us that we have broken but between 5:30 pm and 7 pm, I barely got a chance to freshen up and had my tea then how would I break 4 or 5 pieces of furniture. Then she said the shipping agency (Gati courier) broke it. The problem is if Gati courier has broken then she should file a claim against Gati. Why would I be at the loosing end. Not only that in the shipping form she has ticked in the option of risk involved during shipment as the “Shipper’s risk”. She didn’t inform us about its condition when she was packing and dismantling. The damages must have been visible to her clearly but still she chose to avoid it, betray our trust and scam us.
Initially when she used to send the picture, it showed a well conditioned bed with no marks, broken pieces and fungus. I believe she used to send the pics from the time when she actually bought it. That is how we fell in to the trap and ended up sending her money. Now this horrible experience has caused mental stress to my wife and made my son disappointed because ever since we ordered this bed he was excited. However, there is no way one can fix this bed. It’s beyond repair. We already consulted a carpenter on 20.07.19 morning.
I kept my cool and I asked Mrs. Thushitha to refund me my money. To which she asked me to send the bed first and then she will give me the money which was not the case when we bought it from her. Not only that I would have to pay for the shipping as well. At first we I didn’t ask for a broken bed. I didn’t want a broken bed. So I told her that why would I pay for the shipment. She started arguing and I didn’t want to argue with a lady so I gave her an another option that she should return my Rs. 9000 back and she and I we both share the shipping cost equally. She denied to this proposal as well.
We are feeling as if somebody made fool of us and now laughing on us. We are cheated, betrayed, falsely informed, tricked and robbed out of our hard earned money. I would like to lodge a case against Mrs. Thushitha Kruthi Velampati. I am attaching the chat history of her with my wife, the photos she used to send and the photos which I took of the damaged bed after receiving it.
I have politely asked her to return to return my money and gave her couple of options but she denied. I also informed her if she doesn’t agree to return my money then I would inform Consumer court to which she said do whatever you can.
I would therefore request you to kindly look in to my case and please help us recover our money. We would like to receive our Rs. 9000 back from Mrs. Thushitha and another Rs. 5000 for the harassment, mental stress and the time which we wasted on this whole ordeal and reimbursement of any other cost that may occur during the pursue of this case. We would also like that this damaged bed should be picked up by Mrs. Thushitha by a courier service arranged and paid by her.
