Receiving a 2nd Hand Mobile instead of new

On 22nd Sept 2016 I was ordered for a new Mobile Redmi note 3 from e-bay. It was heated now. Yesterday after serving from excursive servicing center of Redme I came to know that mobile was placed order for Mr. Vinay on 20th July 2016. And that mobile warrenty will be expired on 19th. July 2016

That means same mobile 1st sale to Mr. Binoy & used by him after 2 month later same mobile (2nd hand)sale to me instead of new.

Now I want to replace the same otherwise refund my money 11599 Rs.

Advice me How to claim refund/ replacement of that mobile?
