Claim for compensation for lost goods by Deliv Logistics

It is submitted by the complainant that:

1. The complainant had asked Mr. Srinivas, the owner of Deliv Logistics/ Srinivas Movers and Packers, to pick up and ship luggage from The National University of Advanced Legal Studies, Kochi (683503) to the residence of the complainant at Indore, Madhya Pradesh (452012). The luggage was packed and picked up on March 12, 2021 by Mr. Srinivas.

2. Mr. Srinivas failed to furnish any receipt, regarding the said transaction, even after numerous communications via call and WhatsApp. Finally, after accepting his mistake that the goods were lost, Mr. Srinivas furnished a receipt.

3. The complainant on realising eventually that the goods will never get shipped asked Mr. Srinivas for the return of goods on 23 March 2021 so that they can be shipped by other movers and packers, to which he readily agreed and it was decided that the packing charges as well as transportation charges would be borne to Mr. Srinivas.

4. The luggage was to be picked from Mr. Srinivas’s warehouse on 23 March 2021 and then the gross negligence of Mr. Srinivas was made known to the complainant. The goods were nowhere to be found and were already shipped to some other location.

5. It was found and accepted by Mr. Srinivas over phone call that the goods have already been shipped and there is no whereabout as to where the goods have been shipped.

6. It should be duly noted that the shipment contains very important documents such as original certificates, books, other government documents and notes (prepared by the complainant over a period of 3 years) of the complainant along with other essentials.

7. Mr. Srinivas was asked every other day to trace the location through phone calls, however, the shipment has not been traced till date.

8. Till date, the complainant has deterred from seeking alternative recourse as the complainant understood how the state of operations were, due to the second wave of COVID-19 pandemic and the lockdown which was in place.

9. Through this complaint, the complainant hereby calls upon Mr. Srinivas to compensate the complainant with an amount of Rs. 30000/- only for the lost goods within 10 days of this complaint and Mr. Srinivas shall be fully responsible for the costs and consequences of further actions.
