Defy Fridge last year and it is under warranty. it doesnt freeze food

Good day, i bought a Defy fridge last year and it is under warranty. it doesnt freeze food and they told me that it has gas leak, technician came and still the problem was still there, i called defy number of times seeking their assistance, i was told the call has been closed, they re opened it and technician never came, the store promised to intervene but failed as well, i later went to the store to ask that they take back the fridge which they did and now they are saying the fault must at least occur 3times before refund or before they can permit that i take another fridge, please advice. We are without a fridge and i had to throw away food because of this, what do i do? buy a new fridge and let the store deal with defy to refund me or what because its 3weeks now without a fridge.
