Non-refund of amnesty scheme by Haryana Urban Development Authority

There is one department called INDIAN RAILWAY WELFARE ORGANISATION under the Ministry of Railways who has constructed a society called RAIL VIHAR SECTOR 45, FARIDABAD after taking land from Haryana Urban Development Authority (a Govt. of Haryana undertaking). In May, 2018, Haryana Urban Development Authority (HUDA) announced an amnesty scheme (copy enclosed) according to which all the Plot/flat holders to whom the plot/flat has been allotted by HUDA, shall be given a discount of 37% on total outstanding amount if the whole payment is remitted with HUDA within the period of amnesty scheme. There are many allottees of Rail Vihar Sector 45 Faridabad who have made the payment of outstanding dues to IRWO to avail this benefit.

The amount paid by these allottees has been deposited with HUDA by IRWO and IRWO has received back some amount as a benefit due to amnesty scheme. It is learnt that this refunded money has been distributed among all the allottees of Rail Vihar Sector 45, Faridabad while it is meant for the allottees who made the payment of outstanding dues against the amnesty scheme. This is an arbitrary and illegal decision on the part of the IRWO.

I am one of such allottees ( flat No. C-7, Rail Vihar Sector 45, Faridabad) who paid Rs.2,38,945/- to IRWO in anticipation that I will get the 37% discount from HUDA. But instead of refunding Rs. 88410( i.e. 37% of Rs. 2,38,945/-) to me, only Rs. 7446/- is proposed to be refunded to me and the balance money which was meant for me, has been distributed to other allottees.

I request your kind intervention in the matter and request to do justice to me by directing the concerned officers of IRWO to reimburse my money of Rs. 88410/- received from HUDA on account of amnesty scheme.
