Regarding stale food

Visited Monginis store, professor chowk, Savedi, Ahmednagar in Maharashtra today. Bought a red velvet cake jar. After coming home when I opened the jar, it stinked like hell. I saw that the expiry date was a few days back. I should have checked the date in the store itself, but the point is customer might be in hurry, and how such leading cake company can sell stale items? Can the company be held responsible for food poisoning? And what about the suffering and monetary loss?
