3Kw solar project installation not done Bearworx Engineering Pvt Ltd

The said company/person contacted me via indiamart for the proposal to install 3 Kw On-grid solar system for the quotation amount of 1,35,000 on June 21st, 2021. I paid a total advance of 38000 towards the project. It's been 9 months since he took the advance. he neither completes the project nor returns the advance amount. He once visited the site with some 2nd class products and did some wiring work and then disappeared assuring me that solar panels will be delivered soon and installation starts. Even after 6 months he is not completing the project nor answered my questions.
Today after a discussion with him he is saying he cant refund the amount and billed me 38k for that small installation work.
He doesn't lift the phone even after lifting the phone disconnects it saying network problem.
