The Complainant purchased Tata Tiago NRG vehicle in 2019 (MH30AZ8413)from authorized Tata Motors outlet at Akola for personal use. The vehicle was regularly serviced at authorized service centres of Tata Motors at Akola and Nagpur.
In February–March 2025, the vehicle started displaying Engine Malfunction / Malfunction Indication Lamp (MIL) warning. The vehicle was repeatedly taken to authorized service station at Akola from March 2025 onwards at least once in every month. Major repairs were carried out between 11/07/2025 to 16/07/2025 for which Rs. 13,500/- was charged and again on 09/09/2025 for which Rs. 6,225/- was charged. Despite these repairs, the malfunction warning repeatedly reappeared within days.
The official information brochure/manual of Tata Motors on its page no 58 clearly states that on ignition all warning lamps including MIL should illuminate briefly and then go off, and if MIL remains illuminated the vehicle should immediately be taken to authorized service station for rectification of defect in engine. However, service personnel repeatedly advised that vehicle was safe to drive even when MIL remained ON, which directly contradicts the manufacturer’s own written safety instructions.
Due to continued inaction, legal notice was issued on 13/02/2026. On 14/02/2026, the vehicle was taken to service station after telephonic request from service centre manager and Rs. 10,465/- was charged for replacement of fuel pump. After these repairs, it was observed that MIL was not illuminating at ignition at all, though other warning lamps were functioning normally, raising serious concern regarding possible disabling or tampering of MIL system. The vehicle was again taken to service station thereafter and repairs were carried out after which MIL started illuminating normally on ignition and then switching off after engine start.
Thereafter the vehicle functioned normally till 30/04/2026. However, on 01/05/2026 at odometer reading of approximately 103100 km, the defect again recurred and MIL remained ON even after engine start and during driving. This defect was immediately brought to the notice of customer care and officers of authorized service station at Akola with request to provide alternative vehicle till proper repairs are carried out, failing which the Complainant may approach Consumer Commission. However, no alternative vehicle has been provided and no effective permanent rectification has been done till date.
The repeated recurrence of defect despite repeated repairs and charges clearly amounts to deficiency in service, unfair trade practice, negligence affecting safety and failure to provide proper service. The Complainant has suffered financial loss, repeated inconvenience, mental agony, anxiety and apprehension regarding safety while driving the vehicle.
The Complainant therefore prays for appropriate directions including permanent rectification under independent technical supervision or replacement/refund of vehicle, refund of repair charges, compensation for mental agony and litigation costs.
