Delay and harrassment by Today Homes

Hello,

We had booked the flat in today's home ridge residency in May 2010 and it was promised to give possession in 30 months but till May 2016 the possession was not given. Now they have sent a letter for "offer to possession" and are not willing to pay any penalty rather:

1. They have claimed that the project is delayed due to agitation in Noida whereas the agitation was mainly in Noida extension and in Gr. Noida.
2. The agitation has caused them in increase of the raw material cost however, if such a case they should come out with exact increase in the cost of raw material certified by an expert auditor.

3. They are also claiming that if the buyer is ready to leave the delayed penalty, they are ready to leave the increase raw material cost.. this is baseless as an the builder is doing a favour to the buyer.

4. the property is not fully ready but has been claimed in the letter that the remaining work will be completed once the remaining payment is received by the builder.. however the remaining payment is supposed to be given at the time of possession and not for completing the remaining work so that the possession can be given.

5. There is no mention of how much increase is applicable on raw material.. ideally it should not be charged for the whole delay but if needed, only for the time till the agitation was applicable in Noida sec 135(if any).. however we think there was no issue in sec 135 in Noida.
