MSI computers - Hard drive crashed within warranty period

I bought MSI laptop from flipkart and within 8 months its hard drive crashed.(warranty 2 years). I contacted the service center and they simply replaced the hard drive however they say they are not responsible for restoring the data to the new hard drive. I have some personal data which I do not want to share with anyone and am not sure what will happen to new hard drive, will they repair it and use at their end or throw it away. I just want to know are computer manufacturer obliged to restore the data or they can play with user data . I can try to recover the data but that would need to open hard drive however company says if I open hard drive then they will not take it back and my security deposit (I am asked to pay 5000 to keep hard drive with me for 20 days and try restoration but cannot open hard drive) and without opening HD its not possible to retrieve data.And to retrieve data it will cost around 4-5000, so I have to spend 5000 to get old HD and to retrieve data more 5000. Once HD is open service center will not take it back so will loose security deposit of 5000, so total amount would be around 10000.
