This Legal Notice is in reference to OSN 493375643. I booked an Ola Share on June 8, 2017 using Ola App for two people including me. Pickup location was Gulmohur Towers, Chiranjeev Vihar, Ghaziabad. Drop location was Vaishali Metro Station. When Cab did not reach the location inspite of 5 minutes having elapsed, I had to call the driver (“Mr.Dharmendra Kumar” as per your APP). The first thing driver told me is that he is at far off place and by the time he will reach the ride will be cancelled (although as per map his location was shown to be very close to my place) and he insisted me on cancelling the ride. When I told him the urgency,he feigned unawareness about my location. Not only did I guide him to my location but for his convenience also came out of my flat and stood on the main road with my aged father. But after some 10 minutes exercise, after making me very late for my inevitable appointment, he finally told me that he cancelled the ride long back. When I told him that my app still shows some 12 minutes time to board, he dared to ask me "abbey pheli baar cab book ki hai kya"(Have you booked the cab for first time) and in reply I told that I will complain against him. Then he told me that “saale gaand maar ke andar kar dunga” (I will fuck your ass) and “teri biwi bhi chod dunga” (I will fuck your wife). Innocent me, without even knowing what would be coming forth, kept the call on speaker and got defamed, abused in front of my parents, colleagues and a friend. I immediately disconnected the call to save myself from embarrassment and further slander.
This unexpected behavior of your employee has caused harm to my image/reputation in front of my parents, colleagues and friends. I had already reported the incident the same day through Ola App but Ola has not shown any seriousness about the same. This lackadaisical attitude puts the safety of millions of passengers at stake and hence this legal notice.
I hereby put you to strict notice that if strict action is not taken against the driver within 3 working days and also if I am not intimated and assured of the same, I will be constraint to inform appropriate authorities, share it on social media and take legal action against Ola and the driver under appropriate provisions of Indian Penal Code, 1860.
