REGARDING REFUND OF THE EXCESS PAYMENT OF RUPEES 85,980.00 PAID BY ME TO Mahagun Real Estate Pvt. Lt

I am a buyer of a flat in the residential project named Mahagunpuram at NH-24 Mehrauli Gaziabad U.P. I had booked the Unit No. 274 Godavari in the Mahagunpuram NH-24 Mehrauli Gaziabad U.P., way back in June 2015 with a promise of delivery of the flat in December 2015 . Though the offer of possession not been made by Mahagun Real Estate Pvt. Ltd. till date. It’s really been a torture for so many years as I am paying rent for the stay in a flat this whole period and also paying the EMI for the Home loan for the same period. This whole time I kept running from pillar to post and at last decided to opt for the FIT OUT option and paid all the dues, as asked by Mahagun Real Estate Pvt. Ltd. representative. After so much of efforts and agony Finally I was handed over the flat (only FIT OUT) on January the 7th this year after making all the dues along with the excess payment of amount Rs. 85,980.00. It happened because of the cheque of Rs. 3,50,000.00, made for Mahagun Real Estate Pvt. Ltd was more than the amount to be paid to you at the time of making the payment.

On January the 22nd 2019, Mahagun Real Estate Pvt. Ltd's representative at Mahagun Real Estate Pvt. Ltd's corporate office at the Corenthum Building, Sector 62, NOIDA, accepted the same cheque making a promise the refunding the excess payment of Rs. 85,980.00 at the earliest, immediately after “Certain Formalities”are over.

Sir/Madam now it’s been more than Three months I paid the full dues along with the excess payment of Rs. 85,980.00, and been asking Mahagun Real Estate Pvt. Ltd. at its corporate office at the Corenthum Building, Sector 62, NOIDA for this issue but till date no satisfactory reply is being given by them. I am being tortured for the giving the more amount than the required from my side. I am being run from pillar to post for no fault of mine. Here I am paying the interest of the amount and Mahagun Real Estate Pvt. Ltd. is keeping that amount it has have no right over.

I request you to look into this matter and sort it out by making them refunding the excess payment of Rs. 85,980.00 at the earliest.
