Recurring Problem with a new cellphone, Purchased a Lava Cell Phone Z70

Purchased a Lava Cell Phone Z70 about 4 months back which started giving problems just after sometime time.It has been serviced by the service centre guys two time with some parts being replaced but the problem still exists. Called up the customer care and was told that Lava has a policy of neither replacing nor doing a refund for these issues and have asked me to visit the service center again and then call the customer care once ahgain and they will let the service centre guys know as to what needs to be done.
Request your help in this case at the urgent as i am not able to use my cell phone
