I booked a flat measuring 1195 sq ft size in Max Royal Project sector 76 Noida in Feb 2011. Our home loan sanctioned from IDBI Bank but the builder did not submit to bank the required documents like approval from Noida authority for one year despite many requests by me. Neither he submitted the other documents to bank like Permission to mortgage and Tri party agreement in time to bank. Due to pendency of such essential documents from builder side, the bank did not disburse the home loan to builder for approz one year. Finally the bank disbursed the amount to builder in March 2013 only after receiving necessary documents from builder.However the builder imposed interest @ 18 % on that amount for that period and forcibly charged Rs 2.3 lakh extra from us else threatened to cancel our unit and forefeit the already paid amount by us to the builder.
We paid the interest Rs 2.3 lakh under protest. Now the project is 3 years delayed and the builder is not ready to pay us the penalty on delayed possession and also not ready to return the amount of Rs 2.3 lakh taken from us in the name of interest on delayed payment.
Neither Builder is sending us the letter for taking possession though possession have been started. It is shear harassment and mental torture as well as the financial loss to me.
