Refund on cancellation of flat booked - Sternal Buildcon Private Limited

I have invested in one under construction flat in an affordable housing scheme with Signature Global – Sternal Buildcon Private Limited (The Developer) in 2017 via application number 8832 for unit awarded 3-306, Tower 3 in The SERENAS, Sector-36, Sohna, Gurugram. All the demands that have been raised by developer on semi-annual basis for under construction property has been paid by me every time.

Now, I have cancelled the unit in December 2018 and want my whole money back. Towards it, developer is saying that they will not refund the GST that has been paid by me in 2017-18 on demands raised since July 2017. As per the builder Buyer Agreement that has been executed, it is clearly mentioned that developer will deduct only cancellation charges which is INR 25,000/- and I am not denying for deduction of that amount which is INR 25,000/-.

Deduction of GST from refundable amount is total loss to me only as Input Tax has been availed by developer, which is around 1 lacs.

GST Departmenmt itself has confirmed that developer can claim refund for the GST that has been paid by them on unit allotted and cancelled later. This is not a small amount for me, for which I am following up with them.

A number of times, I had a word with GST helpdesk, explaining the situation and revert was same, that amount will be refunded by developer including the GST portion for 2017-18.

Request you to take necessary actions against Signature Global and arrange to refund my whole money.
