Delivery boy is not delivered gas; charging 40 rs as delivery charge

I have registered gas in online booking one month ago and still the gas is not delivered. Today (19-Nov-2019) the delivery person came and without checking the house he is considered there is no one in the house and get back the gas without delivering. And every time gas cames the delivery person charges 40 rs delivery charge. Am not sure Why this charge? Is it legal charge amount or not? Is it collected by agency or delivery person illegally? Please check this and do the needful
