Cheating in the name of 14 feet Direct truck by Agarwal Packers and Movers Ltd

My complain is related to shifting of my household goods from Bhopal (Madhya Pradesh) to my hometown, Darbhanga (Bihar) by Agarwal Packers and Movers Ltd. after my superannuation in June’16 .

Mr. Kishen Bansal (9303020279), Marketing Executive, Agarwal Packers and Movers, Bhopal sent me a quotation dated 03 Aug 2016 (Doc. 1) for a 14 feet direct truck, from Bhopal to Darbhanga with full assurance of delivery within five days without any damage to our goods.
My goods were picked up on 09/10/2016 (Doc. 2) in the 14 feet truck , No. MP04 GA 1339 ( Doc 3). I paid Rs.70,478/- as one time full and final payment for transfer of my household goods in a 14 feet direct truck from my house in Bhopal located at 247, Shriram Colony, Hoshangabad Road, Bhopal- 462026 to my house in Darbhanga located at 23/E, Danby Road, Darbhanga-846004. I was fully assured by Mr Bansal that by paying for a complete truck, I would be assured of delivery within five days in the same truck which was used for picking up my household goods in Bhopal.

I contacted Mr Bansal on 12/10/16 many times to know the status but some times I was getting evasive answer and thereafter no response. On 17/10/16, I received a call from a truck driver telling me that he had been given my luggage by Mr Bansal after seven days at Bhopal to take it to Patna. The driver further told that it would take three days to reach to Patna and from there your goods would be sent by Patna Branch of Agarwal Packers and Movers.

However to my utter frustration and disappointment, I was informed by the truck driver on 20/10/16 morning that the goods were not coming in a separate truck as promised at the time of booking and instead my goods were clubbed with goods of some other customer. And also the truck carrying goods of different customers including mine was overturned off the road about 60Km before Patna.
Mr Jha (9934961118), from Patna Branch came to collect my damaged goods at the accident site. I was given mobile no. of Mr. Pawan Punia (9122001415), Marketing Executive of Patna Branch by Mr Jha for delivery of the goods. The goods finally arrived in a Pick–up van, No. BR06GA 2752 (Pl. see Doc.4) not in a 14 feet direct truck for which I had paid, at my doorstep on 21/10/16 and to my horror several of my valuable items were in a pretty damaged state.

On seeing the goods in damaged condition of goods, I called upon Mr. Punia who sounded apologetic and assured me that a surveyor would be sent from Patna to my house in Darbhanga within next two days. The manager however had no justification for why the goods were not transported in a truck directly when I had paid for it. He said that it looks like an issue with the Bhopal team and only they can provide the reason.

He suggested to contact Vigilance Department for further assessment and compensation. In hindsight I realized that I committed another mistake in believing his words as later when I raised this issue with both Mr Punia and Ms Sukhan Jyot (011-45014302) of Vigilance Dept., they said I shouldn't have put my signature on the paper if I was not satisfied with the damage assessment.

I further asked Ms Sukhan by mail (Dated 22/10/16) to address properly my following queries otherwise I would be compelled to move to Consumer forum to settle my claim for compensation.

She assured that she would resolve the issue of compensation for breach of promise made during the time of booking. She tried to pacify the matters by convincing me to settle within Rs.10,000/- for compensation and the trauma. Upon my refusal to accept this meagre amount, she moved my case of compensation to some other higher officer.
I received a call in the second week of Nov’16 by some person to pacify me. For my grievance related to cheating, he asked me to suggest a figure I had in mind as compensation. I pointed out that the compensation amount should be, at the minimum, the difference in rates of Agarwal Packers & Movers between goods transported from Bhopal to Darbhanga in a single truck and as a part load in different trucks. As per prevailing rate of Agarwal Packers Movers this difference is around Rs.45,000/-. I was however shocked to hear that he intended to settle the claims within Rs.10,000/-. I totally refused this offer.

I have not received so far any message from Agarwal Packers and Movers to settle my genuine claims and compensation for trauma, damaged goods, delay in delivery and above all Cheating .
